FULL TERMS & CONDITIONS
1 These Terms & Conditions contain important information in relation to the Try Heineken 3 for Free promotion (the Promotion). By participating in the Promotion, participants agree to be bound by these Terms & Conditions. Any claim for a Gift as part of this Promotion must comply with these Terms & Conditions to be valid.
2 The promoter is Lion-Beer, Spirits and Wine Pty Ltd (ABN 13 008 596 370) of Level 7, 68 York Street, Sydney NSW 2000 (the Promoter).
3 The Promotion commences at 9am AEDT on 1 November 2017 and closes at 11.59pm AEDT on 15 December 2017 (the Promotional Period).
ELIGIBILITY
4 Entry is open to residents of New South Wales, Victoria and South Australia aged 18 or over. However, directors, management and employees of the Promoter are ineligible.
5 All persons who are eligible to participate in this Promotion pursuant to paragraph 4 above, and who otherwise comply with these Terms & Conditions, will receive a Gift as described in paragraph 7 below. This is not a lottery, and chance plays no part in determining who can redeem a Gift. However, a participant may be refused a Gift if providing the Gift would breach any relevant laws, codes, policies or liquor licence terms concerning the responsible service of alcohol. The Promoter supports the responsible service of alcohol, and legal aged consumers are advised to consider the safe drinking levels recommended by the National Health and Medical Research Council in its Australian Guidelines to Reduce Health Risks from Drinking Alcohol , which is currently available at https://www.nhmrc.gov.au/_files_nhmrc/publications/attachments/ds10-alcohol.pdf.
HOW TO PARTICIPATE
6 To participate in this Promotion, an eligible person must complete the following steps during the Promotional Period.
(a) Visit www.haveitall.beer (the Promotional Website), which sets out the licensed venues that are participating in this Promotion (the Participating Venues).
(b) Complete the entry form on the Promotional Website by:
(i) entering his or her name, email address and phone number;
(ii) selecting the Participating Venue at which he or she would like to receive the Gift.
(c) Electronically submit the completed entry form, which will result in the participant receiving an email containing a 'REDEEM NOW' (or similar) button (the Promotional Email).
(d) Visit that Participating Venue during its trading hours, along with a device (such as a smartphone) that can access the Promotional Email.
(e) At the bar of the Participating Venue, click on the 'REDEEM NOW' (or similar) button in the Promotional Email to generate a digital coupon, and show the coupon to the bartender, along with his or her photo identification, in order to redeem a Gift. There is no other way to redeem a Gift.
(f) Once the bartender has confirmed the validity of the digital coupon, he or she will click the ‘REDEEMED’ (or similar) button on the participant's device.
GIFT
7 The Gift will be either:
(a) two free 330mL bottles of Heineken 3 (one for the participant and one for a friend who is aged 18 or over);
(b) two free 285mL glasses of Heineken 3 (one for the participant and one for a friend who is aged 18 or over); or
(c) one free 330mL bottle of Heineken 3 and one free 285mL glass of Heineken 3 (one for the participant and one for a friend who is aged 18 or over),
the choice to be at the sole discretion of the Participating Venue.
8 A strict limit applies of one Gift per person for the duration of the Promotional Period. Each digital coupon will bear the name of the person who completed the entry form, and that person must show his or her photo identification to the bartender when redeeming his or her Gift. No Gift can be transferred to another person, exchanged or redeemed for cash.
9 The Gift is designed to be shared with a friend. The participant must not share the Gift, or any component thereof, with a person who is under the age of 18 or otherwise not legally entitled to drink alcohol. The participant must not drink both components of the Gift him or herself.
10 Once a digital coupon is generated, it will expire after 5 minutes or once the bartender clicks the 'REDEEMED' (or similar) button, whichever occurs earlier. If the coupon expires after 5 minutes, the participant will forfeit his or her right to a Gift. No person may generate a digital coupon or redeem a Gift after the Promotional Period ends.

12 If a Gift, or component thereof, becomes unavailable for reasons beyond the control of the Promoter, the Promoter or Participating Venue may substitute a Gift, or component thereof, of equal or greater RRP value at the sole discretion of the Promoter or Participating Venue, subject to any written directions from the relevant authorities. Gift claimants will not be entitled to any additional compensation in the event that the Gift, or any component thereof, has been substituted at equal or greater RRP value.
GENERAL
13 The Promoter takes no responsibility should a person not have the software, hardware or mobile plan that permits access to, and use of, the Promotional Website. Any costs associated with accessing the internet, downloading data on a mobile device or using any device to access and use the Promotional Website are the sole responsibility of the participant and are dependent on the internet/mobile service provider that he or she uses.
14 To the extent permitted by law, the Promoter (including its officers, employees and agents) will not be responsible for any acts of god, acts of terrorism or war (declared or undeclared), state of emergency, disaster, technical failures, security breaches, direction or decision of a government authority, tampering, unauthorised intervention, fraud, computer viruses or other events beyond the control of the Promoter, which affect the proper or reasonably anticipated conduct or administration of the Promotion, or prevent the transfer of a Gift in accordance with these Terms & Conditions. If such an event occurs, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a relevant regulatory authority.
15 Nothing in these Terms & Conditions limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or malfunction, equipment malfunction, online traffic congestion or damage to hardware or software (whether or not under the control of the Promoter); (b) any theft, unauthorised access or third party interference; (c) any Promotional Email or digital coupon that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by an participant; (e) participation in the Promotion or accepting and/or using any Gift; (f) the conduct, act or omission of a Participating Venue; (g) cancellation or postponement of any portion of the Promotion beyond the reasonable control of the Promoter; or (h) any decrease in the number of Participating Venues due to a cause beyond the reasonable control of the Promoter.
16 The Promoter reserves the right to request verification of age, identity, residential address and any other information from participants relevant to their participation in the Promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any person who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the Promotion.
17 Entry forms remain the property of the Promoter. Details from entry forms will be collected and used for the purpose of conducting this Promotion (which may include disclosure to third parties, including local authorities, for the purpose of processing and conducting the Promotion) and for promotional purposes surrounding this Promotion. By entering this Promotion, participants consent to the collection and use of their information as described and agree that the Promoter may collect and use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes and/or otherwise in accordance with the privacy policy of the Promoter without any further reference or payment to the participant. Participants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 1800 308 388 during office hours. The Promoter's privacy policy contains information about how entrants may access their personal information that is held by the Promoter and seek the correction of such information. The Promoter's privacy policy also contains information about how entrants may complain about a breach of the Australian Privacy Principles by the Promoter and how the Promoter will deal with such a complaint.
18 The agreement that comes into force under these Terms & Conditions is governed by, and must be construed in accordance with, the laws in force in New South Wales, and the Promoter and any consumer who participates in the Promotion submit to the non-exclusive jurisdiction of the courts of that State in respect of all matters arising out of or relating to these Terms & Conditions, and the performance or subject matter of the Promotion.
