1. Agreement
1.1 These terms of service, along with all other terms, conditions, notices and disclaimers contained on the FreeStuff.com.au website (the “Site”) form the terms of service (“Terms”).
1.2 By using the Site or creating an account, you agree that these Terms apply as a legally binding agreement between you and Competitions Pty Ltd (ABN 29 158 189 747) (“we”, “us”), including any amendments to these Terms that may be made by us from time to time.
1.3 If you do not agree to be bound by these Terms, please stop using the Site immediately.
2. Membership & Accounts
2.1 You may browse FreeStuff.com.au without creating an account. Creating a free account allows you to receive personalised deal alerts, save favourites, and access member features.
2.2 By creating an account, you represent and warrant to us that:
(a) you are at least 18 years of age;
(b) you are a resident of Australia; and
(c) all information you provide is and will be complete, true and accurate.
2.3 You agree to:
(a) maintain a valid and accurate profile;
(b) operate only one account — shared or duplicate accounts are not permitted;
(c) keep your login credentials secure and not share access with others;
(d) not use any automated means (bots, scripts, crawlers) in connection with the Site;
(e) notify us immediately if you suspect your account has been compromised.
3. Deals, Coupons & Offers
3.1 FreeStuff.com.au is an aggregator and directory of deals, coupons, free samples, and money-saving offers. We are not a party to any transaction between you and the featured brands or retailers.
3.2 While we use reasonable endeavours to ensure all deals and offers are accurate and current at the time of publication, we cannot guarantee that any particular deal, coupon, or offer is still valid, available, or has not changed.
3.3 Deals and offers may expire, change, or be withdrawn at any time by the relevant brands or retailers without notice to us. We recommend checking the terms of each individual offer directly with the brand or retailer before proceeding.
3.4 We make no representation or warranty as to the availability, price, quality, accuracy, or terms of any deal, coupon, free sample, or other offer featured on the Site.
4. Affiliate Links & Commercial Relationships
4.1 Some links on this Site are affiliate links. When you click an affiliate link and complete a qualifying purchase or action, we may earn a commission from the retailer or brand at no additional cost to you.
4.2 Affiliate relationships do not influence which deals we feature or the accuracy of our content. We only feature deals and brands we believe offer genuine value to our users.
4.3 We may also have paid commercial relationships with certain brands or advertisers. Where content is sponsored or paid for, we will endeavour to make this clear.
5. User Conduct
5.1 You agree not to use the Site to:
(a) post, submit, or circulate any material that is defamatory, offensive, illegal, or otherwise inappropriate;
(b) misrepresent deals, coupons, or offers in a way that could mislead other users;
(c) upload any code, software, or material that could harm, disrupt, or interfere with the Site or its users;
(d) use the Site in any way that infringes the rights of any third party, including intellectual property rights or privacy rights; or
(e) engage in any fraudulent or deceptive activity in connection with deals or offers featured on the Site.
6. Intellectual Property
6.1 All content on FreeStuff.com.au, including text, images, logos, design, and software, is owned by or licensed to Competitions Pty Ltd. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.
6.2 Brand names, trademarks, and logos featured on the Site belong to their respective owners and are used for identification purposes only. Their inclusion does not imply any affiliation with or endorsement by those brands.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, Competitions Pty Ltd and FreeStuff.com.au shall not be liable for any direct, indirect, or consequential loss or damage arising from:
(a) your reliance on any deal, coupon, or offer information on the Site;
(b) any transaction made with a brand or retailer listed or linked on the Site;
(c) any expired, invalid, changed, or withdrawn deal or offer;
(d) any purchase made through affiliate links on the Site; or
(e) any interruption, error, or unavailability of the Site.
7.2 To the extent permitted by law, our total aggregate liability to you in connection with your use of the Site shall be limited to the greater of AUD $10 or the amount (if any) you paid to us in the 12 months preceding the claim. As FreeStuff.com.au is a free service, this will in most cases be nil.
8. Suspension & Termination
8.1 You may close your account at any time by contacting us or using the account settings on the Site.
8.2 We reserve the right to suspend or terminate your account at any time, at our sole discretion, including where you breach these Terms or engage in any conduct that we consider harmful to FreeStuff.com.au, its users, or third parties.
9. Changes to These Terms
9.1 We may update these Terms from time to time. Any updates will be posted on this page. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
10. Governing Law
10.1 These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
